Jimi Wanjigi, the CEO of the Kwacha Group of Companies, claims that police officers destroyed property worth more than Ksh.10 million during a raid on his offices in Westlands, Nairobi, on Tuesday.
Wanjigi, through his lawyer Willis Otieno, appeared in the Milimani Law Courts on Wednesday and claimed that APTU officers sent to arrest him on Tuesday broke into his office and caused extensive damage.
“They broke into the office and damaged over Ksh10 million worth of property,” says one witness. Wanjigi’s lawyer said, “We are still doing assessments to come up with the exact figure.”
Wanjigi’s legal team argued that the arrest was illegal because a court order had already been issued preventing him from being arrested and prosecuted.
You’re going to be wasting your time and the court process if the DPP and the IG are restrained to that extent.” We must all become law-abiding citizens and Kenyan state employees and adhere to the orders of the high court, says Lawyer Willis Otieno.
When the court reconvenes at 1pm, it will be clear whether or not Wanjigi will be charged today based on the aforementioned court orders.
Detectives had to break into one of the buildings at Wanjigi’s offices where he had reportedly locked himself in order to arrest him on Tuesday after a day-long standoff.
A Nairobi magistrate’s court had issued an arrest warrant for the businessman.
Wanjigi, his wife, and a number of other people have been implicated in a land fraud scheme. The claims have been denied by him.
Charged with conspiracy to commit a crime and forging a title deed are two of the charges against him.
An investigation by the Directorate of Criminal Investigations (DCI) found that Wanjigi and his wife Irene Nzisa had conspired to defraud the Kenyan government out of Ksh.1.2 billion through the purchase and sale of land in Nairobi.
On December 10, 2021, the DCI’s land fraud unit sent the inquiry file to the DPP with the recommendation that Wanjigi and Nzisa among others be charged with obtaining Ksh.56 million from Kenroid Limited by falsely claiming they were in a position to sell the company the piece of land along General Mathenge road in Westlands.
