A stunning show of civility was witnessed outside the courtroom after the latest hearing in the defamation case involving Robert Alai and Fred Obachi Machoka.
The pair was seen walking together alongside their lawyers and later shared a meal, a show of cordiality that caught citizens off guard.
Obachi had filed a case in court against Alai after the latter made a post on Facebook that said,” Fred Obachi I feel your ethnic rage. It is just ethnic. Your problem is supply of ARVs not presidency. Does HIV bring insanity nowadays?”
Machoka claims this post falsely portrayed him as HIV positive, mentally unstable and a tribalist. He therefore sued Alai for Ksh.60milion in damages.
During the proceedings, lawyers representing the parties vigorously defended their clients’ positions, highlighting the contested issues at the center of the dispute. However, once the court session ended, the litigants appeared to put aside their courtroom differences.
Alai and Obachi were seen having a conversation and interacting freely with their advocates, demonstrating that legal disputes do not necessarily translate into personal animosity.
Legal experts often note that litigation is intended to resolve disputes through established legal processes and that opposing parties are not required to be enemies simply because they find themselves on different sides of a case.
As the case continues, the unusual post-court meeting between Alai, Obachi, and their lawyers has become a talking point among court observers, underscoring the distinction between courtroom advocacy and personal relationships.
