DCI KINOTI WANTS DPP Noordin Haji arrested

With the DCI now requesting an investigation and prosecution of Noordin Haji for suspected perjury and fraud during consultative sessions for formulating guidelines on terrorism, the supremacy fights between the Director of Public Prosecutions and the DCI have now proceeded to court.
Deputy Director of the Anti-Terrorism Police Unit Martin Otieno swore an affidavit claiming that the DPP had forged an attendance list for a meeting for stakeholders to discuss the newly formulated guidelines on the Terrorism and Terror Financing Act, which included the names of two detectives who had not attended on diverse dates of February 21st and March 2022.
It is also alleged that the DPP forged the residential entries of the aforementioned officers at the hotel where the training was held.
Another allegation made by Kinoti is that a consulting expert who helped create the recommendations was not competent and that he was chosen because of his relationship with Haji.
The DCI, who wants the guidelines removed, has argued that requiring police officers to declassify their operations and methods of investigation, as outlined in the guidelines, puts them at risk of operational dangers that have far-reaching consequences for national security and aids terrorist suspects in evading capture, covering up evidence, and assisting in their own elimination, according to the DCI.
This group, according to Kinoti’s assessment, lacks the skills and technical understanding necessary to effectively investigate and prosecute acts of terrorism and their funding.
Despite being a main agency, the DCI claims it was underrepresented during guidelines formation; there were only two DCI personnel in attendance, while the Director of Public Prosecutions had 12 participants.
According to him, the action was part of a pre-planned strategy to exclude crucial members of the criminal justice system from creating and approving the new standards. There are others who believe that the DPP is hell-bent on taking over the mission of other agencies, even when doing so would be detrimental to the nation as a whole.
During the deadlock between the two offices over suspect processing, the DPP issued a brief statement telling DCI to quit evading his investigation obligations and instead appeal against the high court judgment requiring his agency to generate charge sheets.
Haji added that the High Court’s decision on prosecutorial powers is a reaffirmation of prior decisions by Superior Courts.
Prior to taking any actions that might have far-reaching consequences for the administration of justice, the DPP has promised to work closely with the Inspector General of Police’s office and released a revised charge sheet. He has also invited anybody who feel wronged to pursue legal action.
